General Terms and Conditions of Sale (GTC)

Pixerry Studio (operated by Web Design Code)

1. Purpose

These General Terms and Conditions of Sale (GTC) govern all services provided by Pixerry Studio, operated by Web Design Code, a sole proprietorship registered under SIREN number 931 068 084, with its registered office at 105 CHEMIN de la Grange, 01450 Challes-la-Montagne, France.

Services include but are not limited to: website creation, graphic design, prototyping, web development, and technical assistance.

2. Orders and Quotes

  • Each service is subject to a personalized quote issued by Pixerry Studio.
  • The quote specifies the essential characteristics of the service, the price, estimated deadlines, and execution terms.
  • Quotes are valid for 30 days from their date of issue.
  • The order becomes firm and final upon:
    1. Signature of the quote (physical or electronic) and
    2. Payment of a deposit of 30% of the total amount.

3. Execution, Deadlines, and Revisions

  • Delivery deadlines are indicative unless expressly agreed as binding.
  • Each project phase includes up to two rounds of revisions.
  • Additional revisions or changes not specified in the initial quote will be billed separately or subject to an addendum.
  • All services are performed remotely. No physical products are delivered.

4. Payment Terms

  • The balance of the invoice must be paid within 15 days from the invoice date, by bank transfer only.
  • Late payments may give rise to penalties in accordance with Article L441-10 of the French Commercial Code.
  • Pixerry Studio (operated by Web Design Code) is not subject to VAT (VAT not applicable, Article 293 B of the French General Tax Code).

5. Right of Withdrawal (Consumers Only)

In accordance with Articles L221-18 et seq. of the French Consumer Code, a consumer client has a 14-day withdrawal period starting from the date of signature of the contract.

  • To exercise this right, the client must notify Pixerry Studio by written declaration (email or post).
  • If services begin before the end of the withdrawal period, the client must provide written consent and expressly waive their right of withdrawal.
  • Services already performed before withdrawal remain due.
  • In case of withdrawal, all payments received will be refunded within 14 days of notification.

7. Liability and Insurance

Pixerry Studio exercises its services with due care but is not covered by professional liability insurance.

The client is encouraged to obtain appropriate coverage if required.

8. Intellectual Property

Deliverables remain the exclusive property of Pixerry Studio until full payment has been received.

Upon full payment, rights of use are transferred to the client, unless otherwise specified in writing.

Pixerry Studio reserves the right to include completed works in its portfolio for self-promotion.

9. Cancellation

  • If the client cancels before project start, the deposit remains non-refundable.
  • If the client cancels during execution, the amount corresponding to work already performed will be invoiced on a pro-rata basis, with a minimum of 50% of the total price remaining due.

10. Disputes and Governing Law

  • In the event of a dispute, the parties agree to first seek an amicable mediation.
  • Failing that, the dispute will be submitted to the competent courts of Bourg-en-Bresse, France.
  • These GTC are governed by French law.

Pixerry Studio is the commercial name of Web Design Code.
